Services and scope
Deaton’s Aerial Photography provides FAA Part 107-compliant aerial photography and video, including real estate, commercial, construction progress, events, land, night operations, and light editing. Advanced editing, rush delivery, exclusive licensing, mapping, or expanded scope may require a separate written estimate.
Scheduling and flight conditions
All work depends on weather, airspace, operator availability, safe site access, and FAA restrictions. Unsafe wind, rain, lightning, poor visibility, equipment issues, or regulatory restrictions may require delay or rescheduling. The pilot in command has final authority over flight safety and legality.
Approval, deposit, and date confirmation
A quote request begins Under review and does not collect payment. After the project is accepted and required documents are signed, a Square deposit invoice may be issued. The standard deposit is 25%. Jobs exceeding 60 round-trip miles generally require 50% in advance. No flight date is reserved until the required deposit is received.
Deposit timing
Deposits are normally due within 36 hours of invoice delivery. If service is within three days, payment is due within 12 hours. If service is within 18 hours, the deposit is due immediately. Failure to pay may release the requested date.
Final payment, protected previews, and delivery
The remaining balance is due after editing and before release of original-quality downloads. Deaton’s Aerial may show protected, watermarked, reduced-resolution, streaming, or otherwise limited previews for review before full payment; preview access does not transfer usage or download rights. For projects with multiple addresses, each property is treated as a separate job and its final balance is due when that property’s media is ready.
Travel
Travel is calculated round trip from the operating origin near County Road 45 and US Highway 411 in Centre, Alabama. Applicable travel may include a rental vehicle, estimated fuel, lodging, parking, tolls, baggage, equipment handling, airport transportation, and a configurable travel expense buffer. Rental billing time is separate from safe operator duty time. Airfare and unusual long-distance travel remain estimates subject to confirmation and administrative approval.
Cancellation and rescheduling
For local jobs, deposits are refundable when cancellation or rescheduling occurs at least 48 hours before the scheduled start. Long-distance and extended-travel work must be changed at least 48 hours before travel begins. Nonrefundable travel expenses and late cancellation charges may apply.
Property authority and access
The client represents that they own the property or have authority from the owner or manager to permit access and drone operations. The client must provide safe access, disclose hazards, coordinate personnel, secure animals, and supply venue, HOA, or permit approval when required.
Authority challenge protocol
If permission is challenged on site, the operator may land and pause. The first 30 minutes are a courtesy hold. Standby after that period is billed in 15-minute increments at $25 per increment. If authority cannot be resolved, the session may be suspended and rescheduled.
Construction and land documentation
Construction flights document visible progress and are not formal inspections or code-compliance verification. Agriculture and land photography documents the property visually and does not constitute crop analysis, agronomy, surveying, or diagnostic imaging unless separately contracted.
Media ownership and client license
Captured media remains the intellectual property of Deaton’s Aerial Photography. After full payment, the client receives a nonexclusive, nontransferable, royalty-free, perpetual license for the agreed project, listing, documentation, and related marketing uses. Resale, relicensing, transfer, or exclusive use requires written permission.
Portfolio use and releases
Deaton’s Aerial Photography may use project media in its portfolio and marketing unless the client opts out before final delivery. The client is responsible for necessary property, model, minor, venue, and participant releases. A separate media release is used when recognizable people require consent.
Revisions, acceptance, and files
Unless a project scope says otherwise, clients have five business days after delivery to report material technical defects. Two rounds of light revisions are included. RAW files, substantial re-edits, new shots, and expanded deliverables are not included unless agreed in writing. Project media is generally retained for approximately 24 months; clients are responsible for their own backups.
Liability and legal terms
Deaton’s Aerial Photography maintains commercial liability insurance. To the extent allowed by law, liability is limited to fees paid for the affected service, and indirect or consequential damages are excluded. Alabama law applies, with venue in Cherokee County state courts unless otherwise agreed.

Accepted clients receive prefilled, project-specific versions through the secure portal. Signed documents are locked with their version, signer, timestamp, and project record.
